Terms and Conditions
These Terms and Conditions (“Terms”) govern the use of ticketWP’s website, software, plugins, services, and related offerings. By purchasing, accessing, or using any ticketWP products or services, you agree to be bound by these Terms in full.
If you do not agree with these Terms, you must not proceed with purchase or use of ticketWP services.
1. Scope of Services & Limitations
ticketWP will make every reasonable effort to implement the features, functionality, and services outlined in the agreed-upon proposal, invoice, or scope of work.
However, the client acknowledges and agrees that:
• Certain requested features or functionality may be technically incompatible with WordPress, Elementor, ticketWP’s plugin architecture, or third-party ticketing providers.
• ticketWP will communicate any known technical limitations that prevent a feature from being implemented as requested.
• Where feasible, alternative solutions may be proposed at ticketWP’s discretion.
• ticketWP is not required to perform additional development, customization, or work outside the original agreed scope without a separate agreement.
The client understands that not all requested features may be possible due to platform, API, or third-party limitations.
2. Third-Party APIs & Ticket Exchange Dependencies
ticketWP integrates with third-party ticketing providers and APIs, including but not limited to VictoryLive, TicketNetwork, and Automatiq.
The client acknowledges and agrees that:
• The project is dependent on the client’s ability to successfully obtain API credentials and documentation from the selected ticket exchange.
• Failure to obtain an API key, approval, or required documentation is not grounds for a refund.
• If the client is unable to obtain access to a specific ticket exchange, ticketWP may, at its discretion, develop the platform using an alternative exchange already supported by the ticketWP plugin, provided the client can supply valid credentials.
• ticketWP is not responsible for delays, denials, suspensions, or restrictions imposed by third-party ticketing providers.
3. Fixed Pricing & Scope Control
All proposals and invoices issued by ticketWP are fixed-price agreements unless explicitly stated otherwise.
This means:
• The total project cost is locked and will not increase for the services listed in the agreed scope.
• The client will never be billed additional fees for in-scope work.
• Any requests outside the original scope—including additional features, integrations, redesigns, or structural changes—require a separate agreement and pricing approval.
4. Payment Terms
Project & Monthly Fees
• Required monthly fees become due when the website is live in a demo or staging environment.
• Optional monthly services become due when the website is live in a production environment.
• All invoices are due according to the payment terms stated on the invoice.
Project Completion
• Final project completion is determined solely by ticketWP, based on delivery of the agreed scope—not subjective client satisfaction or future enhancement requests.
Failure to remit payment may result in suspension or termination of services.
5. No Refunds & Cancellation Policy
All ticketWP products and services are non-refundable.
This includes, but is not limited to:
• Software licenses
• Website development
• Hosting
• Configuration
• Integrations
• Design work
• Consulting
• Ongoing services
If the client cancels a project at any stage:
• All payments made up to that point are forfeited
• No refunds, credits, or charge reversals will be issued under any circumstances
Failure to remit final or ongoing payments may result in suspension, disabling, or removal of the website or services at ticketWP’s discretion.
6. Chargebacks & Disputes
By purchasing ticketWP services, the client agrees not to initiate chargebacks or payment disputes without first contacting ticketWP.
In the event of a chargeback, ticketWP reserves the right to submit evidence including:
• Signed proposals and invoices
• Proof of service delivery
• Access logs and provisioning records
• Communication history
• Acceptance of these Terms
Chargebacks initiated in violation of these Terms may result in immediate service termination.
7. Hosting, Access & Security
Unless otherwise agreed in writing:
• Hosting environments, credentials, and access methods are managed by ticketWP
• ticketWP may suspend access if payments are overdue or Terms are violated
• The client is responsible for safeguarding any credentials provided to them
ticketWP is not liable for damages caused by client-side changes, third-party plugins, or unauthorized access.
8. Limitation of Liability
To the fullest extent permitted by law:
• ticketWP shall not be liable for indirect, incidental, consequential, or special damages
• ticketWP’s total liability shall not exceed the total amount paid by the client for services rendered
ticketWP does not guarantee revenue, ticket sales, search rankings, or business outcomes.
9. Estimate Expiration
All estimates and proposals are valid for three (3) days from the date of issuance unless otherwise stated.
If the client does not accept within this period:
• Pricing, scope, and availability may change
• A new estimate may be required
Proceeding after expiration constitutes acceptance of revised terms if applicable.
10. Modifications to Terms
ticketWP reserves the right to update or modify these Terms at any time. Continued use of services constitutes acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction in which ticketWP operates, without regard to conflict of law principles.
